In 2017 Canadian Common Law Intersected with Multiculturalism to Juxtapose the Ideal of Diversity that Transitioned to Fight Islamophobia.
“I find that the accused probably had sex with his wife on many occasions without her specific consent, as both he and she believed that he had the right to do so,” Ontario Superior Court Justice Robert Smith said. Although she did not always consent, the couple both believed it was the husband’s right, the Ottawa Citizen reported.
The female has a special and honoured role within Islam that is codified in Islamic doctrine. Before it can be applied Islamic doctrine must be interpreted.
What do senior Muslim leaders in Canada teach about consent of a wife before husband can commence with the act of copulation? Below are six examples. To learn more
Imam Shabbir Ally: There is no ‘consent’ in Islamic marriages. Citing the teachings in Islam, Shabir Ally said, “The woman’s main responsibility in a marriage is to fulfil the sexual needs of her husband. And for that reason the husband has the right and claim to this (referring to sexual intercourse). And she cannot refuse.
Imam Musleh Khan: “She should not withhold sex from her husband without a valid excuse. If she refuses without a valid reason, then she has committed a major sin. This is unanimous among scholars of Islam…Especially for a man, the way Allah created him. Many, many times he may need his wife there more than she might need him. This is just the nature of men. This is just a nature that Allah created us with. So, Sisters, it’s part of your act of worship towards Allah.”
Imam Abdi Hersy: “If she just refuses because she is angry at you, it is not something that she can punish you with avoiding sex. This is something that she granted and agreed upon when she was signing the marriage contract.”
Women in Islamic Shariah P.17: “Everything in this world is a piece of property or a possession. The best possession in the world is a pious woman.”
The Fragile Vessel P 78: “It is, therefore, a great obligation upon the wife to always be available for the consummation of her husband’s desire. It is a major sin for her to deny her husband the intimate pleasure that he seeks with her. Refusing to do that is a major sin that deserves the Angels’ curse and Allah’s wrath.”
Imam Abu Bilal Philips: “According to Sharia, there is no such thing as marital rape when a couple are married. There are specific specified rights. Among rights of a male is when he demands sexual relations, she must comply.”
Toronto Imam Shabbir Ally gave an interview about women’s’ role toward the husband. It was uploaded In April of 2017.
For example you have Hadith that says if a man’s body were covered in sores from head to toe and his wife would you lick the pus out of the sores to cleanse them, then she still would not have fulfilled her duty to her husband.
Host: So just speaking on this one, I know that, well, I’ve heard of it as a weak narration, so is it possible that some of these problematic ideas, while there are many is there a common understanding that these are some of the weaker sources, or you think the challenge is that they exist and people still believe it
They are from the weaker resources, in fact, neither of these two are from bukhari and Muslim, which are the most authentic collections. But they are found in, for example, this last one about the prostration, it is found among the books which is known as Al-Sitta [six authentic books of Hadith]. They are viewed with some kind of expectation that they are authentic enough to be followed… The most recently, a celebrated Hadith scholar, Nasir Al-Din al-Albani, went through this Al-Jami’ as-Saghir by [Islamic scholar Jajaluddin from hundreds of years ago. Now he started to label the hadiths which ones are authentic and which ones are not, based on his expertise in testing these hadiths all over again, and this one comes out as authentic one… But you will find that to this day you have, for example, a website where people send their questions in. Muslims want to know about their belief in practice and the answers are given from an authentic perspective. Look, we are citing the Quran, we are citing the authentic Hadith. Never mind the weak Hadith here and this one is of the Hadith for example somebody asks what about this woman who is giving back talk to her husband. Well, the scholar comes out lashing at this woman with Hadith like this. The one about the prostrating before your husband. I mean if that were at all allowable. Following off with this about licking the puss out of the sores.

Question: A wife is constantly arguing with her husband … What advice can you offer this couple, in particular the wife?
“’If a man were covered from head to foot with weeping sores oozing pus, and his wife were to come to him and lick his sores (to clean them), this would not fulfil the rights he has over her.’” (Reported by Imaam Ahmad, 12153; Saheeh al-Jaami’, 7725).
Canadian Imam Sayyid Rizvi is a senior respected leader who is active in guiding the Canadian Muslim community. Imam Rizvi released a statement that was uploaded Nov 21 2020 concerning the “Islamization” situation in France
The country that gifted the statue of Liberty to the Americans itself is now curbing the rights of Muslim women to where the hijab in government buildings. And now on the pretext of fighting extremism president macron has asked Muslim leaders to accept a charter of Republican values… What they will do through this Charter is monitor and control the accreditation of the Imams. And this is where we have a problem with it. The charter also says that foreign interference in Muslim groups will be prohibited. Video
Democracy is a man-made system, meaning rule by the people for the people. Thus it is contrary to Islam, because rule is for Allaah, the Most High, the Almighty, and it is not permissible to give legislative rights to any human being, no matter who he is.
It says in Mawsoo’at al-Adyaan wa’l-Madhaahib al-Mu’aasirah (2/1066, 1067):
Undoubtedly the democratic system is one of the modern forms of shirk, in terms of obedience and following, or legislation, as it denies the sovereignty of the Creator and His absolute right to issue laws,
Shabbir Ally is a Toronto imam & president of The International Toronto Dawah Center. Imam Ally gave an interview that was uploaded on April 21 2017. This interview helps both Muslim & non-Muslim understand the misunderstood, “Problematic aHadith”, regarding men molesting women and how it can be deemed the woman fault if she is.
The other verse in question the 33rd chapter 59th verse which says, tell the believing women to draw a part of their outer garments around themselves, or close to themselves, so that they will be recognized and not molested… And yet, in some interpretations, scholars have said in fact, it’s very common to find in the classical exegesis of the Quran that scholars have said the woman must cover her face when she goes out of her house… There are other indications in the Hadith there’s a Hadith that says that when the woman reaches the age of puberty it is not lawful for her to expose except for this and this. And according to the Hadith the prophet pointed to his face and hands. view video

“O Prophet! Tell your wives and your daughters and the women of the believers to draw their cloaks (veils) all over their bodies (i.e. screen themselves completely except the eyes or one eye to see the way). That will be better, that they should be known (as free respectable women) so as not to be annoyed (molested). And Allaah is Ever Oft‑Forgiving, Most Merciful”
Ibn ‘Abbaas (may Allaah be pleased with him) said: “Allaah commanded the believing women, if they go out of their houses for some need, to cover their faces from the top of their heads with their jilbaabs, and to leave one eye showing.”
The comment “and leave one eye showing” is a concession because of the need to see the way; if there is no need for that then the eye should not be uncovered.
